According to California EPA’s Office of Environmental Health Hazard Assessment (OEHHA): The California Safe Drinking Water and Toxic Enforcement Act of 1986 (“Proposition 65”) requires the State to publish a list of chemicals known to cause cancer or birth defects or other reproductive harm. The current list contains over 900 chemicals which include everything from naturally occurring substances to chemicals used in manufacturing and processing of products.
How does Shaxon Industries provide the warning?
According to California Proposition 65, it is the duty of Shaxon Industries to advise its customers of potential presence of chemicals or substances from the +900 listed by the state of California that may do harm. Our product warnings, where applicable, are clearly labeled on the product or the packaging of the product. Furthermore, all shipments to California have a warning clearly displayed on the packing note.
Proposition 65 applies to any company doing business in the state of California. Our products are sold and distributed through several channels into California, including by representatives located in other states or countries. To ensure products entering California carry the right labeling, Shaxon Industries often provides the warning on affected products, regardless of destination in the United States.
What does it mean if a product carries a Proposition 65 warning?
The warning does not mean our products will cause cancer or reproductive harm, nor that the products are in violation of any applicable safety standards or regulations. Prop 65 is simply a public “Right to Know” law requiring information about the product and whether the product contains a chemical from the list that individuals may potentially be exposed to. Our products may have traces of chemicals or substances from the list that are a constituent element in materials used. For example, Shaxon products may contain DINP (Cancer) or Lead (Reproductive Harm), which are included on the Prop 65 list and trigger the need for a warning.
